These Terms and Conditions (“Terms”) govern your use of the credential evaluation services provided by Atlas Credential Evaluations (“Atlas,” “we,” “us,” or “our”), including our website, associated materials, content, and services (collectively, the “Services”).
By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
We may modify these Terms at any time. Any changes will be effective upon posting the revised Terms on our website. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
Eligibility
To use our Services, you must be at least 18 years old. By using the Services, you represent and warrant that you meet this requirement.
Account Registration
You may be required to create an account to access certain Services. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate and complete.
You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
Security
By using the Services, you agree not to engage in any actions that are unlawful, disruptive, harmful, or otherwise detrimental to Atlas or its operations. Prohibited activities include, but are not limited to:
Atlas reserves the right, at its sole discretion and without prior notice, to suspend, restrict, or terminate access to the Services for any user or entity found to be in violation of these Terms or who poses a threat to the security, integrity, or availability of our Services.
While we offer communication via email for the exchange of information, please note that email transmissions are not encrypted and may be intercepted by unauthorized third parties. Emails may also contain harmful software, including viruses or malicious code, that could interfere with your devices or systems. Atlas disclaims all liability for any loss, damage, or issues resulting from email communications or any other electronic interactions with our Services.
Atlas Credential Evaluations provides credential evaluation services to assess the equivalency of academic qualifications obtained outside the United States. Our evaluations are based on the information and documents you provide and are intended for use by academic institutions, employers, licensing boards, and other organizations.
Atlas reports are non-binding and intended for advisory purposes only. Atlas does not guarantee that any institution, organization, or agency will accept or agree with the conclusions of our evaluations, nor do we assume responsibility for any decisions made by third parties who use them. Our reports reflect Atlas’s professional judgment, informed by extensive research and years of experience in comparative international education.
We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time without notice. Atlas reserves the right, at its sole and absolute discretion, to decline the evaluation of documents from certain institutions.
If Atlas determines, in its sole and absolute discretion, that any submitted document contains factual inaccuracies or has been altered, forged, or tampered with in any way, we reserve the right to cancel the application without prior notice to the applicant. In such cases, all submitted documents, including originals, will become the property of Atlas, and no evaluation report will be issued. Atlas will notify all designated recipients listed on the application form, as well as any relevant authorities. Any fees associated with such documents will not be refunded.
Additionally, if Atlas discovers that a document connected to a previously issued evaluation report has been falsified, altered, or contains inaccuracies, the evaluation report will be rescinded. All recipients of the report, along with appropriate authorities, will be informed.
All documents submitted to Atlas Credential Evaluations that are not originally in English must be accompanied by a complete and accurate English translation. Translations must be prepared by a qualified translator and include a signed statement attesting to the accuracy of the translation and the translator’s credentials.
Atlas reserves the right to reject translations that do not meet our standards for accuracy, completeness, or format. In some cases, Atlas may require translations from certified or professional translation services at the applicant’s expense.
In instances where Atlas performs the translation of documents, we make every reasonable effort to ensure that the translation is accurate, complete, and reflective of the original content. While we strive to maintain the authenticity and integrity of translated materials, Atlas cannot be held liable for any errors, omissions, or interpretations that may affect the evaluation outcome. Any discrepancies between the original and the translated text may influence the final results of the evaluation.
Fees for our Services are specified on our website and are subject to change without notice. All fees are non-refundable unless otherwise stated.
Payment must be made in full before we commence any evaluation. We accept payment from all major debit/credit cards and PayPal as indicated on our website. All fees are in U.S. dollars.
You are responsible for providing all necessary documents for the evaluation. Documents must be authentic, complete, and submitted in accordance with our guidelines. Atlas reserves the right to reject and refuse any documents at our own discretion.
All documents submitted become the property of Atlas and will not be returned unless explicitly stated. We reserve the right to verify the authenticity of any documents provided.
Your use of the Services is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information. By using our Services, you consent to the practices described in the Privacy Policy.
All content and materials provided through the Services, including but not limited to text, graphics, logos, and software, are the property of Atlas or its licensors and are protected by intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works of any content without our prior written consent.
The Services are provided on an “as-is” and “as-available” basis. We make no warranties, express or implied, regarding the accuracy, completeness, or reliability of the evaluations or the Services.
To the fullest extent permitted by law, Atlas disclaims all liability for any damages arising out of or related to your use of the Services.
You agree to indemnify and hold harmless Atlas Credential Evaluations, along with its affiliates, officers, directors, employees, consultants, representatives, and agents, from and against any and all claims, demands, actions, liabilities, losses, damages, expenses, and costs (including, but not limited to, reasonable legal, accounting, and professional fees), whether actual, threatened, or pending (collectively, “Claims”), arising out of or related to:
(a) your use of the Services (or any use through your account), except to the extent such Claims are directly caused by Atlas’s gross negligence or willful misconduct;
(b) your violation of these Terms and Conditions;
(c) any materials, documents, or information you submit in connection with your account (“User Materials”); or
(d) any activities initiated or conducted through your account.
This indemnification obligation survives termination of your use of the Services.
These Terms are governed by the laws of the State of Connecticut and the federal laws of the United States applicable therein, without regard to its conflict of law principles.
Any disputes arising under these Terms shall be resolved through binding arbitration in Bridgeport, Connecticut, in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.
We reserve the right to suspend or terminate your access to the Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users or us.
